QLD – Enduring Power of Attorney and Advance Health Directive forms and matter types

In accordance with changes to guardianship laws and forms that commence 30 November 2020, the following changes have been made to forms and matter types:

FORMS:

Form updates and where relevant, new versions of the form have superseded the older versions of the forms (Forms 2, 3, 4, 7):

  • Form 1 General Power of Attorney (LL-QLD-WPA-12)
  • Form 2 Enduring Power of Attorney – Short form (LL-QLD-WPA-09)
  • Form 3 Enduring Power of Attorney – Long form (LL-QLD-WPA-06)
  • Form 4 Advance Health Directive  (LL-QLD-WPA-03)
  • Form 5 Revocation of General Power of Attorney (LL-QLD-WPA-16)
  • Form 6 Revocation of Enduring Power of Attorney (LL-QLD-WPA-15)
  • Form 7 Interpreter Translator statement (LL-QLD-WPA-14)

New forms and explanatory guides have also been added:

  • Form 8 Additional page (LL-QLD-WPA-18)
  • Form 9 Enduring Power of Attorney – Explanatory guide (LL-QLD-WPA-19)
  • Form 10  Advance Health Directive – Explanatory guide (LL-QLD-WPA-20)

MATTER TYPES:

The matter types have been renamed and the forms coded accordingly as follows:

Matter Type Name Matter Type Use – Form Coding
Advance Health Directive When using this matter type the POA and AHD forms will automate for either:
* One Client [appointing any number of appointees] or
* Two Clients [separately appointing any number of appointees]
Advance Health Directive – Two people appointing each other When using this matter type the POA and AHD forms will automate with Client 1 and Client 2 mutually appointing each other [plus any other appointees]
Power of Attorney When using this matter type the POA and AHD forms will automate for either:
* One Client [appointing any number of appointees] or
* Two Clients [separately appointing any number of appointees]
Power of Attorney – Two people appointing each other When using this matter type the POA and AHD forms will automate with Client 1 and Client 2 mutually appointing each other [plus any other appointees]
Will When using this matter type the POA and AHD forms will automate for either:
* One Client [appointing any number of appointees] or
* Two Clients [separately appointing any number of appointees]
Wills – Two people appointing each other When using this matter type the POA and AHD forms will automate with Client 1 and Client 2 mutually appointing each other [plus any other appointees]

IMPORTANT:

For automation of Forms 3 and 4, ensure the drop down list is completed as to how the attorney is to be appointed, for “Financial”, “Personal or Health”, or “Financial and Personal/Health” matters:
