  • Form 36B – Response to formal offer (other than acceptance) [LL-SA-DSCI-305];
  • Form 36A – Withdrawal of formal offer  [LL-SA-DSCI-304].

SA – Probate – CourtSA

The South Australian Probate office will be moving towards a digital filing system as of 26 November 2018.

As digital filing is mandatory as of 26 November 2018, we will be removing forms that are now required to be generated in the CourtSA Probate system on 26 November 2018.  We understand there will be additional oaths and affidavits that can be generated, scanned and uploaded to CourtSA.  We will endeavour to have those additional forms available in LEAP.  At this time, CourtSA have advised there is no integration available with any Practice Management Systems.

SA – Probate

The new LEAP automated versions of the Affidavit of Assets and Liabilities and the Certificate of Disclosure are now available.

  • Form 55 – Affidavit of Assets and Liabilities – NEW (LL-SA-DSCI-267);
  • Form 57 – Certificate of Disclosure –NEW (LL-SA-DSCI-268).

Please read the Information Guide before using the new versions as it contains instructions for successful use of the two automated forms with new Probate matters as well as existing Probate matters.

SA – Probate Supplementary Rules 2015

The Probate Supplementary Rules 2015 come into operation on 1 July 2015.

 The old forms have been removed and the new forms are in LEAP.  See below list for form names, numbers and precedent codes.

 Important note:

Database and calculation changes are necessary for the Affidavit of Assets and Liabilities and Certificate of Disclosure and these are currently in progress.  Therefore, the new Affidavit of Assets and Liabilities (Form 55) and Certificate of Disclosure/Registrar’s Certificate (Form 57) currently do not have any automation.  This will only be for a short period of time.

Form 1 – Affidavit of due execution (LL-SA-DSCI-183)
Form 2 – Affidavit of plight and condition and finding (LL-SA-DSCI-186)
Form 3 – Affidavit as to alias – will (LL-SA-DSCI-177)
Form 4 – Affidavit as to alias – intestacy (LL-SA-DSCI-176)
Form 5 – Affidavit of identity – name changed since will (LL-SA-DSCI-280)
Form 6 – Affidavit of identity – name in will incorrect (LL-SA-DSCI-289)
Form 7 – Affidavit to withdraw will deposited under s 6 or s 7 of the Wills Act 1936 (LL-SA-DSCI-281)
Form 8 – Affidavit to withdraw will deposited with renunciation (LL-SA-DSCI-196)
Form 9 – Affidavit verifying the translation of a will or other document (LL-SA-DSCI-197)
Form 10 – Affidavit of service of warning and of search and non-appearance (LL-SA-DSCI-187)

SA – Affidavit of Assets and Liabilities and Certificate of Disclosure

New automated Affidavit of Assets and Liabilities (LL-SA-DSCI-267) and Certificate of Disclosure (LL-SA-DSCI-268) forms have been created and are now available in LEAP.

The new Affidavit of Assets and Liabilities will include all selected Assets, Assets Held and Liabilities entered into your matter and automatically display them in the correct order required by the court regardless of order of entry into your matter.

The new Certificate of Disclosure will create a single document containing separate certificates (one per page) for each selected Asset or Asset Held in your matter.

IMPORTANT NOTE:

There have been numerous database design changes to the Assets, Assets Held and Liability Tables.

Please read the Matter Guide, it contains screen shots of the new Assets, Assets Held and Liability Tables along with instructions on how to complete the tables to ensure your Affidavit of Assets and Liabilities and Certificate of Disclosure both work correctly.

The Matter Guide also contains instructions on how to use the new forms with existing matters.

All States and Territories – Estates

On the Administrator table, calculation “xx – Relationship to Deceased” will be deleted on 24 April 2012, as it is a duplication of calculation “Relationship or capacity (multi)”.  Please modify any Estates precedents you maintain to ensure the calculation scheduled for deletion is not being used.
