NSW – Probate details table

Following client feedback requests, the following fields have been added to the Probate details table:

  • Date of Codicil 2
  • Witnesses to Codicil 2 (both witness names are to be entered in the one field)

All Court forms have been amended, where necessary, to include the correct fields or calculations regarding Codicils.

These changes to the Probate details table are responsive, that is they will take effect in new and existing Matters.

IMPORTANT: As the ‘Witnesses to Codicil 1’ and ‘Witnesses to Codicil 2’ fields replace the old ‘Witness 1’ and ‘Witness 2’ fields, you should check existing Matters to ensure that any data entered in the old Witness to Codicil fields have populated correctly and update accordingly.

NSW – Births Deaths and Marriages forms

The following forms have been updated to the 1 July 2019 form versions:

  • Birth Certificate – Form 7  (LL-NSW-GEN-0072)
  • Death Certificate – Form 10 (LL-NSW-GEN-0073)
  • Marriage Certificate – Form 12 (LL-NSW-GEN-0074)

NSW – Improvements to Estate matter types

NSW Estate tables have received improvements so that matter completion aligns with matter processes.  These changes do not generally affect current fields and coding, however where they do, forms have been re-coded.

Estate details – Probate, Letters of Administration and Estate General matter types

  • Fields have been re-ordered in these tables to align with matter processes
  • Probate and Letters of Administration now follow the same layout for easier user completion
  • The ‘Age at death’ field has been automated to calculate from the ‘Date of Birth’ and ‘Date of Death’ fields entered on the Deceased’s card under the People tab – therefore dececeased’s DOD and DOB must be completed
  • References to Newspapers have been removed due to NSW Online Registry publications
  • Notations appear in blue font for easy identification

Estate details – Grant of Reseal matter type

  • The ‘Age at death’ field has been automated to calculate from the ‘Date of Birth’ and ‘Date of Death’ fields entered on the Deceased’s card under the People tab – therefore dececeased’s DOD and DOB must be completed

Estate Accounts details

  • References to Newspapers have been removed due to NSW Online Registry publications

Assets table

  • The ‘Asset to be’ dropdown list has been updated to include ‘Realised’ and ‘Unrealised’ options
  • The wording of the ‘If transferred, to whom’ has been changed on the layout to read ‘If transferred/bequeathed, to whom’
  • The wording of the ‘Date Sold/Transferred’ has been changed on the layout to read ‘Date Sold/Transferred/Realised’

These changes have been made to assist with future projects to create an automated Distribution Statement or Statement of Assets, Liabilities and Distributions.

Critical Dates

Renaming Critical Dates ‘Notice of intended application published’ and ‘Notice of intended distribution published’ so that they both refer to the word ‘published’ not ‘advertised’ for consistency.

Default tables used

  • Addition of ‘Transferor’ and ‘Transferee’ card types to the default table types in applicable matter types
  • Removal of unused card types, such as Newspaper etc, from the default table types
  • Slight re-ordering of default table types

NSW – New Interactive PDFs

Have you used one of the new NSW Interactive PDFs yet?  They are now LIVE in Guides & Precedents.

They are very user friendly and some of the features include:

  • easily editable within the body of the form (unlike LRS locked Word versions)
  • no lengthy FILLINS just one dialog window for completion (where applicable)
  • easily add Annexure pages (where applicable) within the PDF
  • form reproduction is correct as the PDF is the authority’s form version
  • save the PDF to your file and simply UPDATE any changes from the LEAP toolbar within the PDF

IMPORTANT: There are some specific software requirements for this form to work correctly, including:

  • LEAP Version 1.17 must be installed; and
  • Adobe Acrobat Reader DC (which is a free version) must be installed.

To start, 11 Land Registry Services and 5 Revenue NSW most commonly used forms have been created as Interactive PDFs:

Land Registry Services

  • Transfer – Form 01T (LL-NSW-RPA081)
  • Transfer without monetary consideration – Form 01TWC (LL-NSW-RPA082)
  • Lease – Form 07L (LL-NSW-RPA083)
  • Request for CoRD holder consent – transacting party (LL-NSW-RPA089)
  • Request for CoRD holder consent – third party (LL-NSW-RPA090)
  • Transmission application by an executor, administrator or trustee – Form 03AE (LL-NSW-RPA084)
  • Transmission application by a devisee, beneficiary or next-of-kin – Form 03AD (LL-NSW-RPA085)
  • Notice of death – Form 02NT (LL-NSW-RPA086)
  • Variation of lease – Form 07VL (LL-NSW-RPA087)
  • Surrender of lease – Form 07DL (LL-NSW-RPA088)
  • Withdrawal of caveat – Form 08WX (LL-NSW-RPA091)

Note:

  • To use either of the above Transfer documents across any matter type (other than Conveyancing matter types) simply edit-table-types and enter a Transferor and Transferee card table within your matter.
  • LRS unfortunately have drafted their Request for CoRD holder consent PDFs so that users can only print and not save the PDFs – please print and scan to your LEAP matter until LRS fix their PDF form version.

Revenue NSW

  • Purchaser declaration form – individual – Form ODA 076I (LL-NSW-OSR671)
  • Purchaser declaration form – corporation or government – Form ODA 076NI (LL-NSW-OSR676)
  • First home buyers assistance application form – on or after 1 July 2017 and lodgement guide – Form ODA 066A (LL-NSW-OSR678)
